5 EYEWITNESS NEWS - SALUTE A SENIOR SWEEPSTAKES
OFFICIAL RULES
1. HOW TO ENTER/PLAY: NO PURCHASE NECESSARY. In order to enter, from 5:00 a.m. on Wednesday, May 15, 2013, through 9:00 a.m. on Monday, May 20, 2013, go to www.kstp.com, click on the keyword "contests", complete the entry form (which includes your name, address and daytime telephone number), and submit a photograph of your child who is a high school graduating senior and a message of congratulations. All entries must be received by 5 Eyewitness News no later than 9:00 a.m. on Monday, May 20, 2013. 5 Eyewitness News is not responsible for problems sending the email entry, technical or atmospheric conditions that disrupt the completion of the entry, or any other problems which might or might not result from this contest. Limit, one (1) entry per person/student; any person submitting more than one entry may be disqualified. In order to be eligible, the photograph must be in focus and of a quality that will broadcast well. If photograph is not of such quality, the entry will not be included in the random drawing.
2. HOW THE WINNERS ARE CHOSEN: From all eligible entries received pursuant to Paragraph 1 above, one (1) entry will be randomly drawn before the 5:00 a.m. newscast on Friday, May 17, 2013, Monday, May 20, 2013, Tuesday, May 21, 2013, and Wednesday, May 22, 2013. The winning photo, along with the congratulations message submitted, will be displayed and read each day in the 5:00 a.m. - 7:00 a.m. newscast on May 17, 2012, May 20, 2013, May 21, 2013, and May 22, 2013. The winners will also be notified by telephone and/or e-mail. The prizes will be awarded to the graduating seniors.
3. CLAIMING YOUR PRIZE: Each winner must claim his/her prize in person at the 5 Eyewitness Studios, 3415 University Avenue, St. Paul, Minnesota 55114, during normal business hours (Monday-Friday, 9:00 a.m. to 5:00 p.m.) within ten (10) days after the day he or she wins. If the graduating senior is a minor, the prize must be accepted by the graduating senior's parent and/or legal guardian. This is to verify that the prize is being given to the qualified winner. Failure to comply with this deadline shall be deemed to be the winner’s forfeiture of his or her right to claim a prize. Each winner must present identification acceptable to 5 Eyewitness News (e.g., state drivers license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification). If a winner cannot prove he or she is qualified to accept the prize, the prize will not be awarded. All unclaimed prizes remain the property of 5 Eyewitness News.
4. PRIZE: There will be four (4) prize winners in this contest. Each winning graduating senior will receive a $50 Visa gift card. The gift cards are subject to the policies, practices and procedures regarding Visa gift cards. A qualified winner must also meet the eligibility requirements as set forth in Paragraph 5 of these rules. All income taxes and other taxes are the responsibility of the winner. A 1099 form may be submitted to all appropriate taxing authorities, and by signing the Prize Release, the winner accepts the prize, and even if the winner does not use the prize, he/she will be responsible for the applicable taxes.
Odds of winning are dependent on the number of eligible entries received.
5. ELIGIBILITY RESTRICTIONS: Individuals must be 18 years or older to be eligible to participate in this contest and the parent and/or legal guardian of the senior whose picture is being submitted. Prizes will be awarded to the graduating senior. Employees and the immediate family of employees of Hubbard Broadcasting, Inc. or KSTP-TV, LLC, including their subsidiaries, affiliates, parent or related companies, are not eligible to enter. Any one participating in this contest or claiming a prize in this contest in violation of these rules will be deemed to have forfeited the right to be awarded a prize in this contest and will be disqualified from participating in 5 Eyewitness News contests for a period of one year.
By entering this contest, each entrant is certifying that he or she is not a professional photographer, that the submitted photograph is his or her own original work, and that he or she has the right to allow the publication of the photograph without restriction, and that KSTP-TV's use of the photograph will not infringe the rights of any third parties (e.g., copyrights, rights of publicity, etc.), and any third party (or his/her parent/legal guardian if that person is under 18) featured in the photograph has provided entrant with consent to be depicted in the photograph for purposes set forth in these official rules.
6. CONTEST DEADLINE. All entries must be received by 5 Eyewitness News no later than 9:00 a.m. on Monday, May 20, 2013, to be eligible. 5 Eyewitness News is not responsible for lost, late, misdirected or incomplete entries.
7. RELEASE; CONSENT TO USE LIKENESS, VOICE AND ADDRESS: By participating in this contest, each winner: (a) agrees to release and indemnify Hubbard Broadcasting, Inc. and KSTP-TV, LLC (including their subsidiaries, affiliates, parent or related companies) from and against any and all liability, claims, damages and actions arising directly or indirectly out of or sustained in connection with the awarding, acceptance or use of the prize(s), and (b) consents to the use by the sponsors for promotional purposes only of his or her likeness and/or voice (including but not limited to their photo may be shown on 5 Eyewitness News and/or posted on the website) without any additional compensation. By accepting the prize, each winner agrees to be bound by these official rules, including the preceding release. By participating in this contest, each participant agrees to the application of these official rules.
8. WINNERS LIST: For a list of winners, send a separate self-addressed, stamped envelope before June 30, 2013, to Winners List, Salute A Senior, 5 Eyewitness News, 3415 University Avenue, St. Paul, Minnesota 55114.
9. MISCELLANEOUS: Decisions of 5 Eyewitness News concerning any and all matters with respect to this contest shall be final. 5 Eyewitness News is not responsible for printing errors in the contest materials or these official rules. 5 Eyewitness News reserves the right to change these rules, as well as the terms and conditions of this contest, without notice. 5 Eyewitness News reserves the right to change the prize values at any time, or to substitute prizes of comparable value. If the sponsors determine in their sole discretion that the integrity or fairness of this contest has been corrupted in any manner, the sponsors reserve the right to terminate the contest and to select a winner from among entries legitimately received prior to termination. Contest is void where prohibited or otherwise restricted by law.
