5 EYEWITNESS BEST BACKYARD RINKS CONTEST
OFFICIAL RULES
1. HOW TO ENTER: NO PURCHASE NECESSARY. In order to enter, from 5:00 a.m. on Monday, February 4, 2013, through 5:00 a.m. on Wednesday, February 13, 2013, go to www.kstp.com, click on the keyword "contests", complete the entry form, which includes attaching a photograph of your backyard ice rink, your name, address and telephone number. 5 Eyewitness News is not responsible for problems sending the entry, technical or atmospheric conditions that disrupt the completion of the entry, or any other problems which might or might not result from this contest. Limit, one entry per person/household; any person/household submitting more than one entry may be disqualified.
2. HOW TO PLAY: Enter as explained in Paragraph 1 above. In its sole and absolute discretion, 5 Eyewitness News staff will choose the second through sixth top scoring photographs to be runner-up winners during the term of the contest, based on the following criteria: visually interesting (51%) and unique in size or shape (49%), and each one of these five photographs will be displayed each night in the 10:00 p.m. newscast from Monday, February 11, 2013, through Friday, February 15, 2013; these five (5) winners will each win the prize listed in Paragraph 4 (a) below. The entry with the highest score using the judging criteria above will be the grand prize winner and will have their ice rink shown “live” on 5 Eyewitness News morning between 5:00 a.m. and 7:00 a.m. on Monday, February 18, 2013; this grand prize winner must be available at his/her home on Monday, February 18, 2013; and this grand prize winner will receive the grand prize listed in Paragraph 4 (b) below; if the grand prize winner is not available for the live broadcasting on Monday, February 18, 2013, between 5:00 a.m. and 7:00 a.m., the next highest scoring entry will be chosen from the remaining eligible entries and in such event, that runner up will forfeit the prize listed in Paragraph 4 (a) and instead receive the prize listed in paragraph 4 (b).
3. CLAIMING YOUR PRIZE: Each prizes listed in Paragraph 4 (a) below will be mailed to the winner’s home address. KSTP-TV is not responsible for problems resulting from the mailing of the prize to the winners’ home address. The prize listed in Paragraph 4 (b) below will be delivered to the winner’s home on Monday, February 18, 2013.
4. PRIZE: There will be six (6) prize winners in this contest. The following prizes will be awarded:
a. Five (5) runner-up winners will each receive a gift certificate from Subway redeemable for one (1) three foot party sub; value of each prize is $41.22.
b. One (1) grand prize winner will receive a gift certificate from Subway redeemable for one (1) six foot party sub; value: $82.44; and four (4) tickets to the Minnesota Wild game on Wednesday, March 27, 2013; value: $284. The winner’s ice rink will also be showcased on 5 Eyewitness News Morning on Monday, February 18, 2013, between 5:00 a.m. and 7:00 a.m. and breakfast will be supplied by Subway (25 Subway breakfast sandwiches – Value: $75). Provided, however, in the event of a breaking news story that prohibits the live broadcast from the winner’s ice rink location, the winner will still receive the prizes, but the live remote will either happen on another day or will not happen.
The certificates are subject to all policies, practices and procedures of Subway. A qualified winner must also meet the eligibility requirements as set forth in Paragraph 5 of these rules. All income taxes and other taxes are the responsibility of the winner. A 1099 form may be submitted to all appropriate taxing authorities, and by signing the Prize Release, the winner accepts the prize, and even if the winner does not use the prize, he/she will be responsible for the applicable taxes.
5. ELIGIBILITY RESTRICTIONS: Individuals must be 18 years or older to be eligible to participate in this contest and reside in the Twin Cities metropolitan area. Employees and the immediate family of employees of Hubbard Broadcasting, Inc., KSTP-TV, LLC or Subway, including their subsidiaries, affiliates, parent or related companies, are not eligible to enter. Anyone participating in this contest or claiming a prize in this contest in violation of these rules will be deemed to have forfeited the right to be awarded a prize in this contest and will be disqualified from participating in 5 Eyewitness News contests for a period of one year.
By entering this contest, each entrant is certifying that he or she is not a professional photographer, that the submitted photograph is his or her own original work, and that he or she has the right to allow the publication of the photograph without restriction, and that KSTP-TV's use of the photograph will not infringe the rights of any third parties (e.g., copyrights, rights of publicity, etc.).
6. CONTEST DEADLINE. All entries must be received by 5 Eyewitness News no later than 5:00 a.m. on Wednesday, February 13, 2013, to be eligible. 5 Eyewitness News is not responsible for lost, late, misdirected or incomplete entries. 5 Eyewitness News is not responsible for problems sending the entry, technical or atmospheric conditions that disrupt the completion of the entry, or any other problems which might or might not result from this contest.
7. RELEASE; CONSENT TO USE LIKENESS, VOICE AND ADDRESS: By participating in this contest, each winner: (a) agrees to release and indemnify Hubbard Broadcasting, Inc., KSTP-TV, LLC and Subway (including their subsidiaries, affiliates, parent or related companies) from and against any and all liability, claims, damages and actions arising directly or indirectly out of or sustained in connection with the awarding, acceptance or use of the prize(s), and (b) consents to the use by the sponsors for promotional purposes only of his or her likeness and/or voice (the photo may be shown on 5 Eyewitness News and/or posted on the website) without any additional compensation. By accepting the prize, the winner agrees to be bound by these official rules, including the preceding release. By participating in this contest, each participant agrees to the application of these official rules.
8. WINNERS LIST: For the names of the winners, send a separate self-addressed, stamped envelope before March 15, 2013, to Winners List, Best Backyard Rinks contest, 5 Eyewitness News, 3415 University Avenue, St. Paul, Minnesota 55114.
9. MISCELLANEOUS: Decisions of 5 Eyewitness News concerning any and all matters with respect to this contest shall be final. 5 Eyewitness News is not responsible for printing errors in the contest materials or these official rules. 5 Eyewitness News reserves the right to change these rules, as well as the terms and conditions of this contest, without notice. 5 Eyewitness News reserves the right to change the prize values at any time, or to substitute prizes of comparable value. If the sponsors determine in their sole discretion that the integrity or fairness of this contest has been corrupted in any manner, the sponsors reserve the right to terminate the contest and to select a winner from among entries legitimately received prior to termination. Contest void where prohibited or otherwise restricted by law.
